CANCELLED. Reigning in Tech Giants: Resale price maintenance clauses in online distribution

Date:

Friday, March 13, 2020, 12:00pm to 1:00pm

Location:

RCC Seminar Room, 26 Trowbridge St., Cambridge MA.

New technologies have enabled new distribution models that have led to the emergence of large technological platforms that have positioned themselves as dominant actors in several markets. These platforms expand their domain over markets through the acquisition of other companies that once acquired operate from within them or through agreements with them. In this way, they are able to solidify economic power and gain political influence unlike any we have seen before. This has rekindled the debate between the Harvard and Chicago Schools about whether competition law has failed because it has been very permissive in controlling vertical mergers and enforcing vertical restrictions.

This talk will explore one of the most conflicting points of that debate: what approach should be given to resale price maintenance clauses. While this debate is ongoing around the world, the talk will specifically focus on the different approaches that Europe and the United States are taking for regulating these clauses.
