#  Demutualization in the European Union: the Spanish perspective

 A mutual insurance company is one of the typical legal forms of insurance companies. Since mutual insurance companies were implemented as legal entities in the Act of 1908, they have undergone significant changes in their main characteristics.

 The transposition of EU law into the Spanish legal regime has motivated multiple changes in the regulation and disposition of our insurance market. However, as of today it seems that the bountiful European legislation has not clearly established the future of mutual insurance companies.

 The ‘LOSSEAR’ and ‘ROSSEAR’ have left numerous doubts on the regulation of mutual insurance companies, leaving this historical judicial form in a nebula of legal uncertainty.

 During the talk we will analyze the legislation that nowadays affects the mutual insurance companies and some of the most relevant issues regarding this judicial form.
